By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ especially in the nature of mandamus directing the respondents to release the family pension after counting previous service rendered by her husband under the Old Pension Scheme. With further direction to the respondents to continue the pension, which was stopped by the respondent-department from 01.08.2008. 3.

CWP No.17062 OF 2016 --2-- thereof, the family pension has been restarted w.e.f. 01.08.2008, the date from which it was earlier stopped and an amount on account of arrears has already been paid. The petitioner has also moved an application dated 08.08.2018 to one of the respondents to the effect that she has received the entire benefits and nothing remains to be recovered by her from any of the respondents. 4.

In view of the fact that relief claimed by the petitioner has already been granted to her, the instant petition has rendered infructuous and the same is disposed of accordingly.
