**** AJAY KUMAR MITTAL, J. (Oral) The challenge in this writ petition filed under Articles 226/227 of the Constitution, is to the election and appointment of respondent No.6 as President of Municipal Council Kaithal-respondent No.3 vide resolution dated 27th June, 2016 and notification dated 15th July, 2016 (Annexures P-13 & P-14 respectively).

After arguing for sometime, learned counsel for the petitioners states that he has instructions to withdraw the present writ petition. Therefore, he may be allowed to withdraw the present writ petition as certain question of fact are required to be proved by leading evidence. However, liberty be granted to the petitioners to file an election petition before the Court of competent jurisdiction.

Dismissed as withdrawn. It shall, however, be open to the petitioners to take recourse to the remedies as may be available to them, in accordance with law.
