This petition has been filed under Section 482 of Cr.P.C for quashing and setting aside of order dated 05.08.2023 (Annexure P-6) passed by the learned Judge, Special Court, Ludhiana vide which the petitioner was declared as proclaimed offender in case FIR No. 189 dated 09.12.2017 (Annexure P-1) under Sections 22 NDPS Act registered at Police Station Dugri District Police Commissionerate Ludhiana.

Learned counsel for the petitioner submits that the allegations against the petitioner are that the petitioner was found in possession of 0.75 grams of heroin. The petitioner had regularly been appearing before the trial court for approximately 4 years. However, the petitioner could not appear before the Courts below on 23.12.2020 inadvertently. As such the learned Special Court cancelled the bail orders of the petitioner and his bail bonds and surety bonds were ordered to be forfeited. Non-bailable warrants of arrest against the petitioner have been issued. CRM-M-28107-2025 2 continuously and, therefore,requests that the impugned order may be set aside. The petitioner undertakes to appear before the trial Court regularly and shall not seek any exemption from appearance.

On the asking of the Court, Mr. Kamalpreet Bawa, DAG, Punjab accepts notice on behalf of the respondent-State. 5.

I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the petitioner, this Court deemed it appropriate to decide the petition, I do not find any legitimate ground to interfere in the impugned order dated 05.08.2023 passed by the learned Judge, Special Court, Ludhiana. However, in case the petitioner surrenders before the Court below within 07 days from today and appears at 10:00 A.M, his application for grant of regular bail shall be considered and disposed of by the Court below on the same very day.

The petition stands disposed of.
