This petition has been filed for grant of regular bail under Section 483 of BNSS in case FIR No. 129 dated 17.12.2024 under Sections 319(2), 318(4), 316(2), 336(2), 338, 336(3), 340(2) BNS registered at Police Station Hathur, District Ludhiana.

The case of the prosecution is that the petitioner along with coaccused Gurcharan Singh and Jagjeet Singh had accepted commission in the land transaction wherein one Nirmal Singh had impersonated himself Nirmal Singh s/o Sarban Singh as owner of the land and had accepted Rs. 15 lakh from the complainant.

Learned counsel for the petitioner submits that the said Nirmal Singh is the main accused as the petitioner had only accepted the amount being broker along with Jagjeet Singh. The petitioner was not aware of the instances
-2of the said Nirmal Singh and acted in good faith. The petitioner is in custody since 30.04.2025.

Mr. Monty Goyal, Advocate appears and accepts notice on behalf of the complainant. He has filed his Vakalatnama in the Court today and the same is taken on record. He has opposed the prayer for grant of regular bail to the petitioner 6.
Mr. Manvir Singh Toor, AAG, Punjab accepts notice on behalf of the respondent-State. Learned State counsel has filed the custody certificate in the Court today, which is taken on record. As per custody certificate, the petitioner is in custody for the last 01 month and 22 days. He vehemently opposes the prayer for grant of regular bail to the petitioner. He fairly admits that the petitioner is in custody since 03.04.2025. The petitioner is not involved in any other case.

I have heard the learned counsel for the parties and perused the record.

Keeping in view the facts and circumstances of the present case and the fact that the petitioner is not involved in any other, the continuous detention of the petitioner would not serve the ends of justice, this Court deems it a fit case to grant the concession of regular bail to the petitioner during the pendency of the trial.

Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on
-3regular bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned.

It is clarified that if on bail so granted through the instant order, the applicant is found indulging in any other criminal case it shall be open to the State to seek cancellation of his bail.
