Keeping in view the rival contentions of the learned counsels for the parties and the fact that case of the present petitioner is on similar footing as that of co-accused namely Salman and Rakesh @ Chiku who have already been granted the concession of regular bail by a Coordinate

-3-  Bench of this Court; present petitioner is in custody for the last more than 01 year, 09 months & 25 days; trial will take sufficient time to conclude and no fruitful purpose would be served by keeping him in custody for any further period 7.

Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate/Chief Judicial Magistrate concerned.

Nothing observed herein shall be construed as an opinion on the merits of the main case.
