(ORAL) This is a petition that has been filed for grant of regular bail to the petitioner in FIR No.140 dated 17.08.2019 under Section 22 of the NDPS Act, 1985 at Police Station Division No.6, District Jalandhar. Counsel for the petitioner herein would contend that the petitioner is in custody for over a year and it would be moot point whether the petitioner herein was in conscious possession of the bag allegedly containing the contraband.
Counsel for the respondent-State opposes grant of regular bail to the petitioner by contending that FSL report has been received wherein the average weight of one capsule was 648 mg and 100 capsules of the same had been recovered from the bag of the petitioner, which were labeled as 'PARVORIN-SPAS', apart from the other recoveries having been made, which is of commercial quantity.
