The petitioner, at whose instance FIR No.0108 dated 11.6.2020 at Police Station Behal, District Bhiwani under Sections 302 and 34 of Indian Penal Code was lodged pertaining to murder of his brother, has approached this Court seeking issuance of a direction for transfer of investigation pertaining to the said case to some independent agency and also for providing adequate security.

I have heard the learned counsel for the petitioner. 3.

This Court does not find any ground for transfer of investigation particularly in view of the fact that this Court vide order dated 29.7.2020 (Annexure P-6) passed in CRM-M-20930 of 2020 had already directed the Superintendent of Police, Bhiwani to ensure that the matter is investigated in PANKAJ KAKKAR 2020.10.12 18:09 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-31992-2020 (O&M) accordance with law and that necessary steps as warranted under law are taken thereupon at the earliest. As such, the aforesaid prayer regarding transfer of investigation is declined.

As regards the apprehension of petitioner regarding threat to his life and liberty, it shall be open to the petitioner to approach the Superintendent of Police, Bhiwani by way of filing detailed representation indicating the reasons for his apprehension. If any such representation is filed, the Superintendent of Police, Bhiwani shall get the same examined and take necessary steps as may be warranted under facts and circumstances of the case. In case it is found that there is a genuine threat to life and liberty of the petitioner, then it be ensured that no harm is caused to the petitioner. 5.

A copy of this order be sent to Superintendent of Police, Bhiwani so as to enable him to do the needful expeditiously.
