Prayer in the present civil writ petition under Article 226 of the Constitution of India is for issuance of a direction to the respondents to release the retiral benefits including pensionary benefits, commuted pension, gratuity, leave encashment, provident fund under the revised pay scales along with other admissible benefits along with interest with regard to the services rendered by the petitioner as Class IV, Safai Sewak in Municipal Council, Kotkapura.
Learned counsel appearing on behalf of respondent No.4 has stated that cheque bearing no.257766 dated 19.03.2021 amounting to 14,27,734/- drawn on Axis Bank Ltd., Kotkapura (Punjab), qua the YOGESH SHARMA 2021.03.22 19:06 I attest to the accuracy and integrity of this document
CWP-16731-2020(O&M) -2payment due towards the petitioner, has already been prepared and the same would be released to the petitioner during the course of the day. In view of the statement made by learned counsel for respondent No.4, learned counsel for the petitioner does not press the present writ petition, however, he seeks liberty to file a representation before the appropriate authority for grant of interest on the delayed payment. The civil writ petition is dismissed as not pressed with the liberty aforesaid. In case the petitioner files the representation for grant of interest on the delayed payment, the same be decided in accordance with law expeditiously and in any case within a period of three months from the date of receipt of the representation.
