Learned counsel for the petitioner submits that the application submitted for examine the witnesses in defence was not happily worded. In the list of witnesses, witnesses No.3, 4, 10 and 13 are relevant witnesses. Learned trial Court dismissed the application by making contradictory observations that none of these witnesses is relevant and at the same time, allowed the petitioner to bring the witnesses on his own. He seeks permission to withdraw this petition with liberty to move fresh application to summon the witnesses mentioned at serial No.3, 4, 10 and 13 by giving the relevance and reasons for summoning of these witnesses and direction may be issued to the trial Court to dispose of his application on merit. Dismissed as withdrawn with liberty as prayed for. On filing of fresh application to summon the witnesses mentioned at serial No.3, 4, 10 and 13, learned trial Court will look into the same and pass appropriate order in accordance with law.
