(Oral) The grievance of the petitioner is that the official respondent(s) have promoted one Ramesh Kumar from the post of Sweeper to the post of Peon despite that the fact that he was junior to the petitioner and the case of the petitioner for promotion had been declined, vide order dated 27.09.2012 (Annexure P-1) on the ground that out of the three sanctioned posts of Sweeper one post is lying vacant. Learned State counsel submits that during the pendency of this writ petition, the promotion granted to Ramesh Kumar, vide order dated 19.01.2013 (Annexure P-2) has since been withdrawn, vide order dated 20.11.2013 (Annexure R-1) as stated in the written statement filed on behalf of respondent Nos.1 to 4.

CWP No.21352 of 2013 -2In view of above, the present writ petition is disposed of with the direction to the official respondent(s) that in future if any promotion is being made on the post of Peon, then the case of the petitioner shall be considered in accordance with law/rules.
