IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 13604 of 2017 Date of decision: 02.11.2017 Surender Singh ....Petitioner(s)
Versus
State of Haryana and others
...Respondent(s)
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA
Present:
Mr. Bhupinder Malik, Advocate, for Mr. Samrat Malik, Advocate, for the petitioner.
Mr. Harish Rathee, Sr. DAG, Haryana.
G.S.SANDHAWALIA, J. (Oral) Counsel for the petitioner submits that he does not wish to press the present writ petition whereby, the order dated 02.06.2017 (Annexure P-3) has been challenged and prays for liberty to approach this Court later. Vide the said order, his joining as Principal at Government Senior Secondary School, Riwari Khera, Jhajjar was cancelled and he was called to join again as Headmaster.
The respondents, in their reply, have submitted that Dinesh Kumar had challenged the appointment of the Headmasters on the ground that they did not have 8 years' teaching experience as Masters and, therefore, they were not properly selected. The writ petition was dismissed on 13.11.2012. Against that, LPA No. 1773 of 2013 had been filed and certain directions had been issued to enquire into the matter regarding the genuineness of the teaching experience of the candidates and a Committee had been constituted. The teaching certificate had been found doubtful and, therefore, show cause notices have been issued to the petitioner for Shivani Gupta 2017.11.06 13:26 I attest to the accuracy and integrity of this document
CWP No. 13604 of 2017 -2cancellation of his appointment as Head Master. It is in such circumstances the petitioner has given an undertaking before the authorities that he wishes to withdraw the present petition, which would be clear from Annexure R-1. However, it is apparent that there has been reference to the present litigation made wrongly and it was subject to the outcome of LPA No. 1773 of 2013. In such circumstances, the present writ petition is accordingly disposed of with liberty to the petitioner to raise the grievance again, if so required.
Ordered accordingly.
