***** Rajan Gupta, J. (Oral) Petitioner has impugned order dated 01.01.2015, Annexure P-2 passed by the Presiding Officer, Industrial Tribunal, Amritsar whereby the application for restoration of the case was dismissed in default. It has been urged before the court that due to the fault of the counsel, plea of the petitioner could not be properly considered.

It appears that the application under Section 33-C(2) of the Industrial Disputes Act was dismissed in default on 07.11.2005. Restoration thereof was sought by way of an application, which was time barred. The court below, thus, declined to restore the matter. It is on record that similar application was dismissed in default on 21.09.1999. This court finds no infirmity with the impugned order. Petition is without any merit and is hereby dismissed.
