Jung, Sarpanch of Gram Panchayat of village Jung, Block Mamdot, Tehsil Guru Hari Sahai, District Ferozepur, is present in person in Court and submitted that the amount of cost will be deposited with the Mediation and Conciliation Centre of this Court today itself. Challenge in the present petition is to the order dated 31.05.2017 passed by the District Development and Panchayat Officer cancelling the allotment of Shamlat land granted on lease to the petitioners. It is not in dispute that the statutory appeal filed against the aforesaid order before filing the present writ petition, is still pending. The same could not be taken up because of pendency of the present writ petition. The appeal is stated to be pending on 02.11.2018.

CWP-13617-2017 (O&M) -2As the petitioners have already filed appeal against the order passed by the District Development and Panchayat Officer before filing of present writ petition, we relegate them to pursue their appeal. This Court at the time of issuance of notice of motion on June 13, 2017 had stayed dispossession of the petitioners from the land in dispute. The interim order shall continue till 02.11.2018, when the appeal is stated to be pending before the Director, Rural Development and Panchayat, Punjab. Thereafter the parties shall abide by any order passed by the Appellate Authority which shall consider the case on its own merits without being influenced of the fact that this Court had passed interim order in this case.
