Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Jatinder Singh son of Darshan Ram alias Darshan Singh in case FIR No. 63 dated 11.06.2019, registered under Section(s) 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985 (hereinafter referred to as "the Act") at Police Station Kabar Wala, District Shri Muktsar Sahib, wherein alleged recovery of 190 tablets of Alprazolam and 240 tablets of Tramadol Hydro Chloride was effected. Learned counsel for the petitioner contended that petitioner was not apprehended on the spot. However, learned counsel fairly conceded that there is one more case under the Act against the petitioner by now. Having heard the submissions made by learned counsel for the petitioner and the fact that identity of the petitioner is not in dispute as he was identified by Constable Harjeet Singh on the spot and he is involved in one more case under the Act.

Criminal Misc. No. M-28860 of 2019 In view of above, no case is made out to grant the concession of pre-arrest bail to the petitioner and as such, present petition stands dismissed.
