***** Rajan Gupta, J. (Oral) Learned State counsel has referred to Para 03 of the short affidavit dated 20.08.2018. Same reads as under:- "3.

That it is submitted that the petitioner and other eligible officers of PES cadre were called for counseling for the posting of D.E.O. (S.E./E.E) and Principal Govt. Inservice Training on 26.07.2017. The employees of PES cadre were allowed Post/Station choice as per seniority. It is pertinent to mention that the name of the petitioner stood at serial No.223 in the seniority list and sanctioned posts of District Education Officers were 41. The senior employees opted for the posts of District Education Officers as a result the petitioner opted for the post of principal. It is pertinent to mention that the pay scale of the principal and District Education Officers is same. It is further submitted that the petitioner has given undertaking in the shape of self declaration to the Department that he do not want to take posting as D.E.O. (S.E./E.

E) and Principal Govt. Inservice Training Centres and he will neither claim the post of District Education Officer nor file any Court Case in this regard. (The self declaration undertaking given by the SUKHPREET KAUR 2019.03.

petitioner on 26.07.2017 is annexed herewith as Annexure R3)". Learned State counsel further submits that in view of the same, present petition has been rendered infructuous. This contention remains uncontroverted.

In view of the above, present petition is dismissed as having been rendered infructuous.
