KARAMJIT SINGH , J. (Oral) Prayer is for grant of anticipatory bail in case having FIR No.90 dated 12.7.2022 registered under Sections 306, 506 and 120-B IPC at Police Station Moonak District Sangrur.
The FIR in the present case was registered on the statement of compalinant-Rajinder Kumar in which he alleged that deceased Pawan Kumar was his nephew and the deceased used to hand over `1,000/- per month to all the accused persons including the present petitioner, who were running some lottery business and used to take out draw of lottery every month and thereafter the accused person expanded their business as per which the lottery draw was to be held after every 20 month and the deceased kept on depositing his money with the accused persons and in all he invested `6 lacs but later on the accused persons refused to return the said amount on which the deceased got upset and committed suicide on 12.7.2022 by hanging himself.

( 2 ) CRM-M-33376-2022 The counsel for the petitioner submits that the petitioner is falsely implicated in the present case and he has joined investigation with the police in the light of previous order of interim bail passed by the Coordinate Bench of this Court and that no suicide note is left behind by the deceased before ending his life.
State counsel on instructions from ASI Balbir Singh has submitted that the petitioner has joined investigation with the police and that no suicide note left behind by the deceased is recovered and that the petitioner is not required by police for further investigation or for custodial interrogation.
The present case involved moot point as to whether there was any intention on the part of the petitioner that the deceased should end his life by committing suicide. The exact complicity of the petitioner would be unfolded during the trial and the petitioner who has joined investigation is not required by the police for any further investigation. In view of the above, without commenting on the merits of the case, the present petition is hereby allowed and order dated 29.7.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
