**** RITU BAHRI , J. (Oral) Petitioner is seeking direction to the respondents to promote her from the post of Staff Nurse to the post of Nursing Sister w.e.f the date person junior to her i.e respondent No. 3 has been promoted. At the very outset, learned counsel for respondent Nos. 1 and 2 has referred to written statement wherein as per seniority list as stood on 1996, the petitioner fall at Sr. No. 421 and respondent No. 3 at Sr. No. 416. As per seniority list stood on 11.08.1998, respondent No. 3 is senior to the petitioner. The petitioner falls at Sr.No. 401 in the seniority list whereas respondent No. 3 falls at Sr. NO. 397. A tentative seniority list was circulated on 12.03.2008 which stood on 15.09.2007. As per tentative seniority list, the petitioner falls at Sr. No. 332 and respondent No. 3 at Sr. No.

329 (Annexure R-2/1 and R-2/2). Learned counsel appearing for respondent Nos. 1 and 2 further submits that with respect to seniority list, the petitioner has not given any objections to the tentative seniority list. Further no replication has been filed to Gaurav Arora 2019.04.

CWP No. 17255-2016 the written statement filed by learned counsel for respondent Nos. 1 and 2. Even if the respondents had not placed on record the merit list prepared at the time of initial selection, that will not condone the delay of the petitioner.

In view of the above factual position, the present petition stands dismissed.
