       This petition has been filed by the petitioner under Sections 11(5) & (6) of the Arbitration and Conciliation Act, 1996 for appointment of sole arbitrator in terms of clause 8.3 contained in the Memorandum of Undertaking dated 17.04.2019 entered into between the parties. In view of the consent of learned counsel for the parties, as recorded in the order dated 22.07.2022 passed by this Court, declaration under Section 12 of the Act was called from Justice Ajay Tewari, a former Judge of this Court, which has been received and placed before this Court. In these circumstances and in accordance with the consensus arrived at between the parties, Justice Ajay Tewari, a former Judge of this Court, is appointed as an Arbitrator to adjudicate upon the dispute between the parties.

Application stands disposed of.
