Due to heavy rain and water logging, the Bar is observing no work day.

The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking directions to the respondents to release interest @ 12% per annum on delayed payment of arrears amounting to Rs.8,44,618/-.

The case of the petitioner is that services of the petitioner came to be terminated on 06.11.2017. The petitioner preferred CWP No.7833 of 2017 before this Court, which was allowed. The petitioner rejoined respondent-department on 06.01.2020. The petitioner was paid arrears of Rs.8,44,618/- for the period from 06.11.2017 to 05.01.2020 in September 2021, thus, there is delay of 20 months in making payment of arrears. The petitioner has served legal notice dated 28.10.2022 (Annexure P-8) upon the respondents for redressal of his grievance, however, respondent has not adjudicated the same.

Without commenting upon the merits of the case, the present petition is disposed of with a direction to respondent No.3 to consider and decide legal notice dated 28.10.2022 (Annexure P-8) and pass a speaking order within 03 months from today.
