(ORAL) The petitioner herein seeks the relief of regular bail in the criminal case pertaining to the FIR bearing No.60 dated 27.06.2019 registered at Police Station Sadar Abohar District Fazilka, under Section 22 of the NDPS Act.
Learned State counsel has forwarded the custody certificate of the petitioner to this Court through e-mail and the same is taken on the record and as mentioned therein, the petitioner was released on interim bail on 23.07.2021 which was extended till 31.08.2021 but neither the petitioner has surrendered in the jail nor any order qua further extension of his interim bail has been received by the Jail Authorities.
It is pertinent to mention here that vide the order dated 19.07.2021 as passed by the Co-ordinate Bench in CRM No.16473 of 2021, SEEMA SHARMA 2021.09.07 16:47 I attest to the accuracy and integrity of this document PHHC

the petitioner was ordered to be released on interim bail for a period of one month from the date of receipt of copy of the said order, on his furnishing the personal and surety bonds to the satisfaction of the Court concerned. A perusal of the order dated 31.08.2021 passed by the trial Court, as forwarded by learned counsel for the petitioner to this Court through e-mail, reveals that it has categorically been mentioned therein that after the order for extension of interim directions till 31.08.2021, no further order has been received from this Court.
Learned counsel for the petitioner has also not been able to place on record any order passed by any competent Court for the extension of the relief of interim bail beyond 31.08.2021.
In view of the afore-discussed facts and circumstances, it is explicit that the petitioner is no more behind the bars and it being so, the cause of action does not survive in his favour to pursue the present petition further and the same does not remain maintainable any more. Resultantly, the petition in hand stands dismissed accordingly. (MEENAKSHI I. MEHTA) JUDGE 02.09.2021.
