ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of anticipatory bail in FIR No.159 dated 28.06.2019, registered under Sections 61/78 of the Punjab Excise Act at Police Station Sardulgarh, District Mansa. The operative part of the order dated 11.07.2019, vide which interim anticipatory bail has been granted to the petitioner, is reproduced as under:- "....Counsel for the petitioner relies upon the order dated 05.07.2019 passed by this Court in CRM-M No.28244 of 2019 vide which similarly situated coaccused of the petitioner namely Subhash Kumar was granted the concession of anticipatory bail on the ground that both of them ran away from the spot and no one was arrested and the recovery of liquor has already been effected.

Notice of motion for 22.07.2019...."

CRM-M No.29029 of 2019 to the order dated 11.07.2019, the petitioner has appeared before the Investigating Officer and has joined the investigation. Counsel for the State, on instructions from ASI Kulwant Singh, has not disputed the aforesaid fact and submits that the petitioner is no more required for further investigation. In view of the above, this petition is allowed and the interim bail granted to the petitioner vide order dated 11.07.2019 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
