PANKAJ JAIN, J. (ORAL) Claimant is in appeal seeking enhancement of compensation awarded by the Tribunal on account of injuries suffered by her in a motorvehicular accident, dated 13.02.2022. 2.

Owing to the injuries suffered by the claimant in the accident, she suffered permanent disability to the extent of 15%. As per the medical evidence, the claimant has difficulty in movement, squatting, sitting cross legged and doing household work. She cannot stand for long hours. The claimant is a home-maker. The Tribunal has assessed the functional disability of the claimant as 10%.

In the considered opinion of this Court, the Tribunal erred in taking functional disability of the claimant as 10%. The claimant is a homeDEEPAK KUMAR 2026.04.21 17:02 I attest to the accuracy and integrity of this document

FAO No.3829 of 2023 maker. Considering the difficulty being faced by her, she will not be able to perform her household chores and shall always need a help. Accordingly, the award is modified to the extent that the functional disability of the claimant is assessed to be 25%.

The compensation awarded by the Tribunal be computed accordingly.

Needless to pay, anything paid to the claimant in execution of the award shall be adjusted and set off.

With the aforesaid modification and maintaining the other heads, the appeal is disposed off.
