The petitioners are seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No.0076 dated 27.05.2024 under Sections 323, 324, 354, 427, 452, 34 of the Indian Penal Code, 1860, registered at Police Station Adampur, District Jalandhar (Rural). 2.

On the last date of hearing i.e. on 31.07.2024, while noticing the following submissions made by the learned counsel for the petitioners, this Court had granted the concession of interim bail to the petitioners and asked them to join investigation:- "Learned counsel inter alia contends that it was essentially on account of a trivial parking dispute that the occurrence in question took place just outside the houses of the parties, who are immediate neighbours. Learned counsel submits that in the occurrence in question, both the parties received injuries at the hands of each other. He has also contended that the petitioners have been attributed simple injuries with a stick on the person of POONAM RATHORE 2024.11.12 18:38 I attest to the accuracy and authenticity of this document High Court Chandigarh the complainant."

Learned counsel for the petitioners submits that in compliance of order dated 31.07.2024, the petitioners have joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions from ASI Satnam Singh, does not dispute the factum of the petitioners having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioners are not required for further investigation much less for his custodial interrogation. 5.

In view of the above, the petition is allowed and interim order dated 31.07.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
