The present writ petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ in the nature of certiorari for quashing the impugned order dated 26.12.2022 (Annexure P2), whereby the non-posting period from 07.07.1999 to 04.10.2000 has been treated as leave of the kind due and the same has been adjusted against the earned leave account of the petitioner, resulting in denial of salary and other consequential service benefits for the aforesaid period. It is contended that the impugned order is arbitrary, erroneous, illegal, contrary to the settled principles of service jurisprudence and wholly unsustainable in the eyes of law. It is further prayed that as a natural corollary to the setting aside of the
impugned order, the respondents be directed to release the salary and all consequential monetary benefits for the aforesaid period along with interest @ 9% per annum from the date the amount became due till the date of actual realization.

Learned counsel for the petitioner at this stage submits that he would be satisfied if a direction is issued to the respondent No.1 to decide the legal notice dated 19.04.2026 (Annexure P-4) by passing a speaking order in a time bound manner.

On advance notice, Mr. Ankit Gaur, Advocate put in appearance on behalf of the respondents and submits that he has no objection in case a direction is issued to the respondent No.1/competent authority to hear and decide the legal notice dated 19.04.2026 (Annexure P4) by passing a speaking order in a time bound manner. 4.
In view of the limited prayer made by counsel for the petitioner without commenting upon the merits of the case, the present petition is disposed of and the respondent No.1/competent authority is directed to hear and decide the legal notice dated 19.04.2026 (Annexure P-4) by passing a speaking order in a time bound manner within a period of three months from the date of receiving a certified copy of this order. Further the decision taken thereof shall be conveyed to the petitioner.

Needless to say, if the petitioner is found entitled to the relief sought, the same be granted forthwith by respondent/competent authority. 6.
Pending miscellaneous application(s), if any, shall also stands disposed of.
