The petitioner has approached this Court under Articles 226/227 of the Constitution of India inter alia seeking quashing of letter dated 29.02.2016 (Annexure P-5) vide which the respondent-authorities have wrongly allotted the tender to the petitioner-firm and order dated 21.07.2016 (Annexure P-11) whereby respondent No. 3 had forfeited the earnest money deposited by the petitioner for allotment of lease of 4 Ton SLR space and also debarred the petitioner from entering into any tender for two years.

Learned counsel for the petitioner submitted that the petitioner had already sent a legal notice dated 01.08.2016 (Annexure P-10) to respondent No. 3 but the same has not been decided by the authority Rishu Kataria 2016.09.21 12:55 I attest to the accuracy and authenticity of this document

CWP-17373-2016 -2concerned, so far. He prayed that he would be satisfied if a direction is issued to the authority concerned to decide the aforesaid legal notice in a time bound manner in accordance with law, after affording an opportunity of hearing to the petitioner.

After hearing learned counsel for the petitioner, perusing the present petition and without expressing any opinion on the merits of the case, we dispose of the present petition by directing respondent No. 3 to decide the legal notice dated 01.08.2016 (Annexure P-10) within a period of one month from today, in accordance with law by passing a speaking order and after affording an opportunity of hearing to the petitioner.
