On our asking, Ms.Kirti Singh, learned Deputy Advocate General, Haryana, accepts notice on their behalf. Let four copies of the writ petition be supplied to the State counsel during the course of day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution. In view of the nature of order which we propose to pass, it is not necessary to seek any counter-reply from respondent Nos.1 to 4 or to serve respondent No.5 at this stage as no order prejudicial to its interest is being passed. Her grievance is that Voter Identity Card No.XLN0587881 has been issued to her by the Election Department on 27.05.2015 but in the electoral roll of Ward No.9 of the Municipality, her name does not find mention as a voter. The obvious effect would be that she will not be able to exercise her right to franchise in the ensuing elections. The petitioner relies upon several official documents to establish her claim as a bonafide resident of Ward No.9, Municipal Committee, Rajound. She has also represented the City Magistrate, Kaithal who is stated to be the Competent Authority to revise the voter list.
In this view of the matter, we dispose of this writ petition with a direction to respondent No.4 to verify the claim of the petitioner as contained in her representation dated 25.08.2015 (P-4), and take an appropriate decision within one week.
Ordered accordingly.
