This petition has been filed under Section 528 of BNSS for quashing and setting aside of order dated 15.05.2025 (Annexure P-4) passed by the learned Judge Special Court, Kapurthala in case CIS No. NDPS/611/2018 vide which trial Court has cancelled the bail bonds of the petitioner and forfeited surety bonds to the State and issued non-bailable warrants of arrest against the petitioner for 08.07.2025 in FIR No. 36 dated 16.06.2018 under Sections 22,61,85 NDPS Act registered at Police Station Rawalpindi Phagwara, District Kapurthala.

Learned counsel for the petitioner submits that the petitioner could not appear before the Courts below on 15.05.2025 due to miscommunication between the petitioner and his counsel. As such the learned Special Court cancelled the bail orders of the petitioner and his bail bonds and surety bonds were ordered to be forfeited. CRM-M-28358-2025 2 against the petitioner have been issued. He further contended that the petitioner may be permitted to surrender before the learned trial Court to attend the trial proceedings regularly and, therefore, requests that the impugned order may be set aside.

On the asking of the Court, Mr. Kamalpreet Bawa, DAG, Punjab accepts notice on behalf of the respondent-State. 5.
I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the petitioner, this Court deemed it appropriate to decide the petition, I do not find any legitimate ground to interfere in the impugned order dated 15.05.2025 passed by the learned Judge Special Court, Kapurthala . However, in case the petitioner surrenders before the Court below within 07 days from today and moves an application for grant of regular bail, the same shall be considered and decided by the Court below within a period of three days.
