The petition has been filed inter alia seeking a writ of mandamus directing the respondents to consider and promote the petitioner to the post of Sanskrit Lecturer/ Post Graduate Teacher (PGT) with all consequential benefits.

As per facts apparent on record, the petitioner was initially appointed as Sanskrit Teacher in the respondent-Department on 14.06.1999/22.07.1999, and subsequently promoted to the post of Social Study Master with effect from 12.12.2010.

Learned counsel for the petitioner contends that as per service rules- the Haryana State Education School Cadre (Group B) Service Rules, 2012 (for short, 'Service Rules') requisite academic qualifications for promotion to the post of PGT Sanskrit is M.A. Sanskrit with at least fifty per cent marks and B.Ed. from a recognised University, along with two years' teaching experience as TGT Sanskrit/Sanskrit teacher. The petitioner fulfills the qualifications, and has more than two years' experience as Sanskrit Teacher as well. Therefore, there is no reason he should not be considered for promotion as PGT.

Learned State counsel, on the contrary, contends that having been promoted as Social Study Master, the petitioner is not in the channel of promotion to the post of PGT Sanskrit, which is meant for the teachers working as TGT Sanskrit.

The facts regarding the petitioner's initial joining as Sanskrit Teacher with effect from 14.06.1999/22.07.1999, and subsequent promotion as Social Study Master with effect from 12.12.2010, are not in dispute. A perusal of Rule 9(i)(i) of the Service Rules makes it apparent that recruitment to the post of PGT Sanskrit is thirty three per cent by promotion from amongst TGT Sanskrit/Sanskrit Teacher. The petitioner, however, is working as S.S. Master and feeder cadre for promotion to the post of PGT Sanskrti is TGT Sanskrit/Sanskrit Teacher. Accordingly, he cannot be considered for promotion. As per Rule 9(i)(c), (e), (f), (g),and (h), Social Studies Masters are eligible for promotion as PGT English, History, Political

Science, Economics and Geography on fulfilling the requisite qualifications. Therefore, the petitioner has a different channel of promotion under the Rules.

In view thereof, there is no merit in the petition, and it stands dismissed.
