G.S.SANDHAWALIA, J. (Oral) The petitioner seeks setting aside of the tentative gradation list of HCMS-I Doctors dated 24.04.2017 (Annexure P-8) whereby, he has been shown at Sr. No. 230. It is his grouse that on an earlier occasion, he was being shown at Sr. No. 167 (Annexure P-7) and has been moved down 63 points.

Notice of motion.

Mr. Harish Rathee, Sr. DAG, Haryana accepts notice on behalf of respondents no. 1 and 3. Requisite number of copies of the writ petition have been supplied to him.

It is not disputed that the petitioner has already filed representation dated 22.05.2017 (Annexure P-9) with respondent no. 2 for setting forth his grievances regarding this aspect. It is his case that the same remains undecided and that the respondents might act upon the subsequent tentative gradation list to his detriment.

Keeping in view the fact that the matter is still pending consideration before respondent no. 2, this Court is of the opinion that respondent no. 2 shall take a decision on the representation dated Shivani Gupta 2017.07.05 10:11 I attest to the accuracy and integrity of this document Chandigarh

CWP No. 13907 of 2017 -222.05.2017 (Annexure P-9) within a period of 4 weeks from the date of receipt of certified copy of the order. In case the petitioner is held entitled for the necessary relief, he shall be granted the same. In case it is to be denied, a reasoned order shall be communicated to the petitioner. Petition stands disposed of accordingly.
