(ORAL) This is the petition that has been filed for grant of regular bail to the petitioner in FIR No.44 dated 13.07.2019 registered under Section 376, 506 IPC and Section 3 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act at Police Station Women Sonepat, District Sonepat.

Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the said FIR. It is argued that prosecutrix and her brother have been examined, who did not support the prosecution version. The investigation has been completed and challan stands presented, therefore, custody of the petitioner would no longer be required. CRM-M No.37438 of 2021 -2levelled against him, however, he submits that the prosecutrix and her brother have turned hostile.

I have heard learned counel for the parties. Keeping in view the fact that the prosecutrix and her brother have been examined, who did not support the prosecution version and the fact that investigation has been completed and challan stands presented, no useful purpose would be served in keeping the petiitoner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on his execution of personal/surety bonds to the satisfaction of concerned trial court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
