Prayer in this writ petition is for issuance of direction to the respondents to grant all the retiral benefits stated to be due to the petitioner, including gratuity, leave encashment etc. along with interest. Learned counsel for the petitioner submits that petitioner retired as Junior Meter Reader on 31.03.2019 from the respondentDepartment. It is submitted that no enquiry whatsoever is pending against petitioner nor is there any recovery to be effected from him. All documentation was completed by the petitioner within the stipulated period and provisional pension was also released to the petitioner in May, 2020, however, full pension has not been released to the petitioner neither his retiral dues released. It is submitted that in this respect legal notice dated 29.03.2022 (Annexure P-5) was also served but to no avail. At this stage, learned counsel for the petitioner restricts the prayer for a decision on the legal notice dated 29.03.2022 (Annexure P-5), in a time bound manner.

CWP-17370-2022 -2Keeping in view the facts and circumstances of this case, but without any expression of opinion on the merits of the matter, this petition is disposed of with a direction to the competent authority to consider and decide petitioner's legal notice dated 29.03.2022 (Annexure P-5), by passing a speaking order, in accordance with law, within a period of three months from receipt of certified copy of this order. In case, petitioner is found entitled to any monetary benefits, same be released within the next two months thereafter.

Writ petition is disposed of accordingly.
