(Oral) The petitioner seeks the relief of consideration and for regularization of services of the petitioner in terms of the government policies issued from time to time on account of a continuous length of service w.e.f. 27.11.1997 on temporary/ad hoc basis. It is pleaded that the appointment of the petitioner was made through employment exchange against a vacant post by a duly constituted Selection Committee and the appointment order has been placed on record as Annexure P-1. It is alleged that vide representation dated 27.04.2011 (Annexure P-10), request had been made for regularization to respondent no. 2 and the same was forwarded to respondent no. 1 on 03.05.2011 (Annexure P-11). Information was also asked for on 17.06.2011 (Annexure P-12) by respondent no. 2 and another representation dated 10.02.
2012 (Annexure P-15) was also made. Reference is made to further correspondence addressed inter se the respondents as per Annexures P-13, P-14, P-16 and P-17. It is thus submitted that the case of the petitioner is SHIVANI GUPTA 2016.01.
CWP No. 175 of 2016 still pending consideration and no concrete action has been taken. Counsel for the petitioners submits that he would be satisfied if a time bound decision is taken by respondent no. 1 on the representations made and duly recommended.
Notice of motion.
Mr. R.S. Sidhu, AAG, Punjab accepts notice on behalf of the respondents. Copy of the writ petition has been supplied to him in Court. Keeping in view the limited relief sought, this Court is of the opinion that there is no need for the respondents to file reply. Accordingly, without commenting on the merits of the case, this writ petition is disposed of with a direction to respondent no. 1 to decide the representations dated 27.04.2011 and 10.02.2012 (Annexures P10 and P-15) on the basis of the recommendation made within a period of 3 months from the date of receipt of certified copy of the order. In case the petitioner is found entitled for the said benefits, the financial benefits be granted within a period of 2 months thereafter. Needless to say if the relief is to be denied, a reasoned order be passed and conveyed to the petitioner. 08.01.2016 (G.S. SANDHAWALIA) shivani JUDGE SHIVANI GUPTA 2016.01.12 11:50 I attest to the accuracy and integrity of this document Chandigarh
