Present petition under Article 226/227 of the Constitution of India for directing the respondents to refix the pay of petitioner by granting increments for the period from 30.06.2013 to 30.08.2013 and from 30.08.2013 to 05.09.2017 as the same period has been decided to be on duty while setting aside his suspension/dismissal orders vide order dated 07.06.2017 (Annexure P3) and he was reinstated and joined his duties on 06.09.2017.
Learned counsel for the petitioner contended that petitioner was facing trial under the Narcotic Drugs & Psychotropic Substances Act, 1985 but he was acquitted of the charges after trial. On the basis of that, petitioner filed a civil suit for the said purpose, which was decided in his favour vide order dated 06.03.2017 and thereafter, he was reinstated into service and this period was treated to be on duty. Civil Writ Petition No. 12221 of 2018 of service for the intervening period, as detailed above. Learned counsel further contended that petitioner would be satisfied if his representation (Annexure P4) is decided by the respondents within a stipulated time frame. In view of above, present writ petition stands disposed of with the direction to the respondents to decide representation dated 10.12.2017 (Annexure P4), filed by the petitioner, regarding refixation of pay by granting increments during the dismissal period from 2013 to 2017 as admissible in accordance with law, within a period of two months from the date of receipt of a certified copy of this order.
