(Oral) The petitioners are legal heirs of late Atma Ram whose land was acquired by the State of Punjab for the development of a scheme known as '25.57 Acres Development Scheme, Bharat Nagar' floated by the Improvement Trust, Bathinda. The land was acquired and its possession was taken in the year 1993. The grievance of the petitioners is that till date the Trust has not invited applications for allotment of residential plots to the 'local displaced persons' like their predecessor-in-interest whose lands were acquired for the development of the subject scheme. A reference is made to Rule 11 of the Punjab Town Improvement (Utilization of Land and Allotment of Plots) Rules, 1983 whereunder every Trust is obligated to invite applications for allotment of residential plots by issuing notice in the newspaper widely circulated in MOHINDER KUMAR 2015.09.08 11:50 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.18498 of 2015 [2] the locality. It is alleged that the predecessor-in-interest of the petitioners died in the year 2013 awaiting such allotment. The petitioners have thereafter raised such a claim vide representation dated 14.08.2015 (P-4).

Having heard learned counsel for the petitioners and considering the nature of relief sought in this writ petition, however without expressing any views on merits or on the allegations, for we have not heard the respondents at this stage, this writ petition is disposed of with a direction to the Improvement Trust, Bathinda to decide the claim of the petitioners regarding allotment of plots in the category of 'local displaced persons', if such a claim is still pending consideration. The needful shall be done within a period of three months from the date of receiving a certified copy of this order.

Ordered accordingly.
