NAMIT KUMAR J. (Oral) Prayer in this petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in FIR No.315 dated 07.11.2022 registered under Sections 307, 341, 506, 148, 149 IPC and Sections 25, 27 of the Arms Act, at Police Station Civil Lines Batala, Police District Batala, District Gurdaspur.

In Para 12 of the petition, it has been stated by the petitioner that he was never declared as proclaimed offender in the present case at any stage. The said averment is wrong as it has been recorded by the Court of learned Sessions Judge, Gurdaspur while rejecting the bail filed by the petitioner in its order dated 10.04.2024 that the petitioner was declared proclaimed offender. Counsel for the petitioner wishes to withdraw the present petition.

Dismissed as withdrawn.
