(Oral)  CM-4667-CWP-2016 Affidavit dated 20.04.2016 of Dhare s/o Sh. Kushal Singh purportedly filed in compliance to the order dated April 6, 2016 is taken on record.

CM stands disposed of.

CWP No.1755 of 2016  (1) In the instant writ petition, challenge laid is to the election of President of Municipal Committee, Pataudi. The President was elected by way of draw of lots on the premise that both the contesting candidates secured 6 valid votes each.

        (2) Since there was a dispute with regard to the validity of one vote which was rejected by the Returning Officer, the original ballot papers as well as video-graphy of the election process recorded by the authorities were summoned. The original ballot papers lying in the sealed cover have been opened. The disputed ballot paper has been seen.

(3) Learned counsel for the petitioners at this stage seeks to withdraw the writ petition with liberty to file election petition. Ordered accordingly. The original ballot paper is ordered to be resealed under the signatures of the Bench Secretary. The election record be also resealed and handed over to the State counsel. (4) With liberty afore-mentioned, the writ petition is dismissed as withdrawn.
