(ORAL) The learned State counsel has very vehemently argued that the recovery was made from the petitioner in the presence of a Gazetted Officer and therefore, he does not deserve the concession of bail. Learned counsel for the petitioner submits that the petitioner having been in custody since 16.5.2018 with not even a single prosecution witness examined so far and no other criminal case registered against him, he deserves the concession of bail. Without making any comment on the actual merits of the case for and against the petitioner, the petition is allowed.
