(Oral) Petitioner-Vikash Kumar @ Vikash @ Ninni, aged 24 years, has filed this petition under Section 483 read with Section 528 of BNSS, 2023, seeking interim bail for a period of one month, on the ground that petitioner is suffering from serious health issues and is admitted in prison hospital, in case FIR No.82 dated 25.02.2022, registered under Sections 21(6), 27-A and 29 of the NDPS Act at Police Station City Tohana, District Fatehabad. 2.
Today status report dated 01.06.2026 is being filed and same is taken on record. Registry to tag the same at an appropriate place. As per status report, initially one accused namely Rohit @ Sumeet was arrested and from whose possession 25 grams of Heroin was recovered. Name of the petitioner was disclosed in the disclosure statement of co-accused Rohit @ Sumeet and thereupon petitioner was also arrested in the present case.

Learned counsel for the petitioner submits that when the petitioner was arrested, no narcotic contraband was recovered from his possession. However, as per the case of prosecution, petitioner also got recorded his disclosure statement of supplying 30 grams of Heroin to accused Rohit @ Sumeet which he had procured from one Saurabh @ Chana. Counsel for petitioner submits that petitioner is facing a serious kidney problem and he requires immediate attention which he prefers to get from some specialized hospital. Medical report dated 26.05.2026 (Annexure R-1) submitted in regard to the petitioner reads as under:- "MEDICAL REPORT OF UNDERTRIAL PRISONER VIKAS KUMAR @ NINI S/O ASHOK KUMAR, CONFINED IN CENTRAL JAIL-2. HISAR.
As per request, S.H.O.. P.S. City Tohana dated 23.05.2026. It is certified that under trial prisoner Vikash Kumar @ Ginni S/o Ashok Kumar, Aged about 26 years at present confined in Central Jail-2, Hisar since 05.07.2025. As per record available at this Jail, the said inmate patient referred to outside hospital for many times with various complaints:- Sr.

Right kidney shown multiple calculi largest measuring 15.6X14.8 mm causing grade II Hydronephrosis.

Left kidney shown few tiny caculi.

Left Ureter shows few calculi at upper 1/3 part cacusing upstream dilatation and Grade I Hydronephrosis in left kidney largest (m) 34X3.2X5.1 mm.
Patient was sent for right ESWL on 04.05.2026 at 10.00 AM at
PGIMS, Rohtak Urology O.T. as advised by Urologist. But patient denied for treatment at PGIMS Rohtak as per record.
Patient is presently on treatment as prescribed by the treating doctor from PGIMS, Rohtak. Further follow up will be done as and when required. Medical health status Report submitted for kind perusal please. Date : 26.05.2026 Medical Officer Central Jail-2, Hisar."
Thus, counsel prays for grant of interim bail to the petitioner. 4.
In view of the poor health condition of petitioner, petition is allowed and petitioner is ordered to be released interim bail for a period of one month, subject to his furnishing bail/ surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/Duty Magistrate concerned, if not required in any other case. Petitioner shall surrender back on 03.07.2026 at 5:00 PM and will not misuse the concession.

The observation made here-in-above shall not be construed as an expression of opinion on the facts of the case and the Trial Court is expected to decide the case on the basis of complete evidence available on record. 6.
It is further made clear that if, in future, petitioner is directly found indulged in similar kind of activities, this order shall be deemed to be cancelled.

Petition stands disposed of accordingly.
