In view of the fact that the fresh auction has taken place in which the petitioner again was the highest bidder, though at a higher leased amount, it appears to us that the instant writ petition has become infructuous. Ordered accordingly.

Learned counsel for the petitioner however, points out that the petitioner was singled out and the land leased to him alone has been put to fresh auction.

If that is so, the petitioner shall be at liberty to question the non-auction of the similarly situated land given to other lessees by impleading them as party-respondents.
