(Oral) The instant writ petition virtually seeks ad-interim prohibitory injunction against the Municipal authorities though such an undertaking has already been given on behalf of the respondents before the Civil Court that the disputed premises shall not be got vacated except in due course of law. It is undeniable that eviction petition under Section 7 of the Punjab Village Common Lands (Regulation) Act, 1961 is still pending consideration and no eviction order has been passed so far. Notice for eviction has also not been served. In these circumstances, we dismiss the writ petition being totally premature. Ordered accordingly.
