This order shall dispose of CRM-M-28282-2025, CRM-M4862-2025, CRM-M-5633-2025, CRM-M-7285-2025, CRM-M-36415-2025 and CrM-M-65553-2025, as all the petitions are interconnected and have arisen out of same FIR. However, the lead case is CRM-M-28282-2025. 2.

The instant petitions have been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioners, during the pendency of trial, who have been booked in a criminal case arising out of First Information Report, as detailed here-under:- Name of Petitioner(s) FIR No.

Shorn of unnecessary details, the facts which are essential for the adjudication of the instant petitions are, that the prosecution agency was set into motion on a complaint made by one Harmanjot Singh and that statement became the bedrock of the registration of the instant FIR. The relevant of the same is extracted hereinafter:- "

Stated that I am resident of the above mentioned address and running a vegetable stall (Farhi) at Chara Mandi Rajpura Town. Yesterday on 25.06.2023 around 10.30 P.M., Hasmukh son of Karam Singh resident of village Dhindsa, Police Station Kheri Gandian District Patiala, who came on his motorcycle No. PB-12-Z-0199, was fighting with a fruit vendor near my stall, whom I, my younger brother Sachinder Singh and Gurmit Sharma son of Roshan Lal, who is resident of our village were trying to understand and stopping him from fighting, but he started abusing and manhandling with us. Then on his call, a car bearing No.PB-39 K-0282 which was being driven by Sandeep Singh @ Sunny son of Gurnam Singh, resident of H.No.6-B, Block No.

10-B, near Vikas Nagar, Rajpura, two other unknown youths came, whom I can recognize when I come across them, who were holding swords in their hands and a Scorpio Car bearing No.PB-65 M-1877, which was being driven by Sukhdev Singh son of Surinder Singh, resident of village Bhateri Police Station Sadar Rajpura, District Patiala, two other unknown youths came, who I can recognize when I come across them, who were holding swords in their hands and Kanwalt Singh son of Harbhajan Singh resident of village Saidkheri Police Station Kheri Gandian, District Patiala also came on the spot on Splendor Plus Motorcycle bearing No.PB-11 CE- 6050, holding stick in his hand.

Then all of them started beating us, on which my brother Sachinder Singh called my uncle Swaran Singh son of Amarjit Singh resident of village Neelpur, Rajpura, they immediately left with their weapons and vehicles and it were they who threatened my uncle by calling.

- 4 - uncle Swaran Singh reached at the spot. Then my uncle told us that we will talk tomorrow morning. While we were still standing at the spot, all the above mentioned people came back to the spot with their vehicle and weapons and Hasmukh said with a challenge that they should not be allowed to leave today. They attacked us with the weapons they held in their hands. Who, with the intention of killing us, inflicted serious injuries on my uncle and my brother Sachinder Singh with swords and sticks. When I and Gurmeet Sharma raised an alarm, a large crowd of people gathered there, seeing which all the above mentioned youths ran away from the spot alongwith their vehicles and weapons." 4.

After 4 days of registration of the above FIR, the statement of injured - Sachinder Singh was recorded on dated 30.06.2023, wherein, apart from eight accused as mentioned in the FIR (supra) (4 known and 4 unknown), 13 more persons were arraigned as an accused, in which the name of one of the accused Jasvir Singh was also figured out. The statement of Sachinder Singh is also extracted hereinafter:- "

We were still present at the spot and in the meantime all above persons armed with their weapons again came at the spot in above vehicles with more persons. Among them were Harvinder Singh @ Hani s/o Charanjeet Singh along with Manjeet Singh @ Mani s/o Nihaljeet Singh resident of Village Nardu, armed with swords, on one bullet motorcycle bearing registration no.PB-11-BN-8331 silver color, Gursewak Singh @ Billas/o Nirbhai Singh r/o village Ghumana in his white colored Skoda car bearing registration no.

PB-11-BM-9797 along with Simranjeet Singh s/o Satnam Singh r/o village Nardu and Gurdeep Singh @ Deepa Ganda s/o Late Ajaib singh r/o village Khanpur Gandian, Gurtej Singh s/o Darshan Singh r/o village Mehma and Pameshar Singh @ Pesu s/o Jang singh r/o village Sohron, who were armed with swords in their hands, and Jasbir Singh @ Batti s/o Baljinder Singh along with Jaswinder Singh @ Banti s/o Mahinder Singh and Amandeep Singh @ Aman s/o Kulwinder Singh r/o village Dhinsa came riding on one bullet motorcycle, the number of which I don't remember now. Among them Jaswinder Singh was armed with danda and others were carrying swords in their hands." 5.

At this stage, learned State counsel has filed the comprehensive status report dated 20.04.2026 and five custody certificates dated 19.04.2026

- 5 - in Court today. Same are taken on record. Office to tag the same at appropriate place.

Copies thereof have been handed over to the counsel for the petitioners.

Besides this, petitioner - Hasmukh Singh (in CRM-M-282822025) and petitioner - Parmeshwar Singh @ Peshu (in CRM-M-4862-2025), are also shown to be involved in four other cases, the details of which are as under:- Hasmukh Singh:- I.

FIR No. 325 dated 09.12.2024 U/s 52-A Prisons Act, registered at Police Station Tripuri, Distt. Patiala - Pending Investigation. Parmeshwar Singh alias Peshu:- I.

FIR No. 77 dated 02.11.2021 U/s 452,323,506,427 IPC, registered at Police Station Kheri Gandian, Distt. Patiala II.

FIR No. 189 dated 04.08.2024 U/s 52-A Prisons Act, registered at Police Station Tripuri, Distt. Patiala - Pending Investigation. 8.

Otherwise also, in the present case, petitioner - Hasmukh Singh (in CRM-M-28282-2025) was armed with sword; petitioner - Hari Singh @ Nishan Singh (in CRM-M-5633-2025) was armed with sword; petitioner - Harpreet Singh @ Preet (in CRM-M-36415-2025) was armed with iron dattar; petitioner - Amandeep Singh @ Aman (in CRM-M-65553-2025) was armed with sword and petitioner - Parmeshwar Singh @ Peshu (in CRM-M4862-2025) was armed with sword, and there are total 19 injuries (incised

- 7 - wounds) were suffered by the deceased - Swaran Singh. Apart this, 03 injuries (incised wounds) were suffered by another injured Sachinder Singh. Therefore, keeping in view the specific role attributed to the aforesaid petitioners; nature of weapons used by them; seriousness of allegations and the fact that two of them are also involved in other criminal cases, prayer for grant of regular bail qua them is hereby dismissed. 9.

So far as petitioner - Jaswinder Singh @ Bunty (in CRM-M7285-2025) is concerned, he was armed with a stick and allegedly gave a stick blow on the right arm of the complainant, which was declared grievous in nature. However, in view of the role assigned to him and the weapon alleged to have been used by him at the time of occurrence, he has already suffered sufficient incarceration inside the jail, i.e. 02 years, 09 months and 11 days up-till 19.04.2026 (as per custody certificate). Therefore, in the totality of circumstances and without commenting upon the merits of the case, I deem it appropriate not to continue his further detention in the present case.

Consequently, prayer made in the present petition, i.e. CRM-M7285-2025 is allowed. Petitioner - Jaswinder Singh @ Bunty is ordered to be released on bail, subject to his furnishing bail/surety bonds to the satisfaction of the learned trial Court/ Chief Judicial Magistrate/ Illaqa Magistrate/ Duty Magistrate concerned, if not required in any other case. 10.

Needless to observe that the petitioner - Jaswinder Singh @ Bunty (in CRM-M-7285-2025) shall not extend any threat and shall not influence any prosecution witness in any manner directly or indirectly. 11.

Any of the discussion done and recorded here above, shall not be construed as an expression of opinion on the facts of the case. Therefore, trial Court is expected to decide the case by taking an independent view, on

- 8 - the basis of evidence available on record, as expeditiously as possible, in accordance with law.

With aforesaid observations, all the instant petitions stand disposed of.

Pending misc. application(s), if any, also stand disposed of. Photocopy of this order be placed on the files of other connected cases.
