***** ARCHANA PURI, J. (Oral) Status report has been received from the court concerned. Perusal of the same reveals that on 14.12.2022, AW1, Somesh Mehra and AW2, Rohit Gupta, were examined and their examination in chief was completed and for the cross examination, it was adjourned for 01.03.2023. Thereafter, for one reason or the other, as evident from the status report, cross examination was not conducted. At the tail end of the report, it is stated that Sh.Maneesh Bajaj, counsel representing the respondent, was suffering from severe disc problem and was on bed rest. On query by the Court, it has been submitted by learned counsel making appearance on behalf of the respondent that his court work is being looked after by the associates, in his office. He has also given an undertaking to examine the aforesaid two witnesses, on the next date fixed before the Court below i.e. 08.01.2024 and the same is acceptable to learned counsel appearing on behalf of the petitioner. 2023:PHHC:164451 CR-3038-2022 In the given circumstances, learned counsel for the petitioner shall ensure the presence of AW1, Somesh Mehra and AW2, Rohit Gupta on 08.01.2024, before the court below and on that date, learned Lower Court shall make an endeavor to conclude the cross examination of both the said witnesses (if possible), on that date or within the next five days. The present revision petition has been filed for seeking issuance of direction to learned Lower Court for deciding the rent petition. However, after the examination of the aforesaid two witnesses, only one witness is to be examined by the petitioner.

In the given circumstances, learned Rent Controller is hereby requested to make an endeavor, to conduct the proceedings, expeditiously and dispose of the case.
