Through instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ especially in the nature of mandamus directing the respondents to count the entire service rendered by him with respondent-department on muster roll/daily wage basis from 10.11.1980 to 31.08.1992, for the purpose of pensionary benefits, in view of instructions issued by the government from time to time. 2.

Learned counsel for the petitioner submits that a legal notice dated 02.04.2018 (P-3) was duly served upon the respondents but till date neither any response has been received nor any decision has been taken thereon. 3.

Learned counsel for the petitioner further submits that petitioner feels satisfied in case direction is issued to respondent No.2 to decide his legal notice in a time bound manner.

Instant petition is disposed of with a direction to respondent No.2 to look into the grievances unfolded by petitioner in his legal notice dated 02.04.2018 (P-3) and to take a conscious decision by passing a speaking order, that too, after giving a patience hearing to the petitioner, within a period of three months from the date of receipt of certified copy of this order. 5.

However, if petitioner still feels aggrieved against any order passed by the aforesaid authority, he shall be at liberty to have recourse to the other remedies available under law as well as to approach this Court.
