S.J. VAZIFDAR, ACTING CHIEF JUSTICE (Oral):

The petitioner has challenged a demand dated 07.08.2015 (Annexure P/5) demanding an enhanced compensation of Rs.15,54,844/-.

The petitioner has not even responded to the notice. The petitioner's contention is that as per the judgment in the land reference, the enhancement is of Rs.1,000/- per square yard. The petitioner's plot admeasures 324 square metres. Thus, according to him, only about Rs.3,77,000/- is payable by him. 3.

In our view, the petitioner must first respond to the impugned notice and seek a clarification as to how the amount has been charged. It is not necessary to protect the petitioner's interest in the meantime for the first instalment of Rs.2,40,651/- is payable on 14.09.2015. It is, therefore, not necessary to entertain the writ petition at this stage. The petitioner is at liberty to pay the first instalment but without prejudice to his rights and contentions including those taken in this writ petition. The second instalment is payable on 16.02.2016. The petitioner is at liberty to file a fresh petition in the event of the decision of the respondents being adverse to him upon the representation to be made by him.
