(ORAL) The petitioner, through the instant petition, is seeking quashing of impugned order dated 06.12.2021 whereby Chief Judicial Magistrate, Nuh has allowed application filed by respondent No. 2 for providing residential accommodation with a direction to the petitioner to pay Rs. 5000/- towards rent and order dated 02.07.2022 whereby ASJ, Nuh has dismissed revision petition filed by the petition. Learned counsel for the petitioner inter alia contends that respondent is staying with her parents and till date she has not shifted to rented accommodation, thus, she is not entitle to rent of Rs. 5000/- per month.

The trial court vide order dated 06.12.2021 has directed the petitioner to pay a sum of Rs. 5000/- per month to the respondent towards rent. The Appellate Court vide impugned order dated PARAMJIT KAUR SAINI 2023.02.22 15:55 I attest to the accuracy and authenticity of this order/judgment

CRM-M-33810 of 2022 -202.07.2022 directed the petitioner to deposit rent in the account of landlord whose house has been taken on rent by the respondent on furnishing of rent agreement.

On being confronted with the findings of the Appellate Court, learned counsel for the petitioner seeks permission to withdraw the present petition at this stage with liberty to file a fresh as and when respondent would shift to rented accommodation and furnish rent agreement.

Dismissed as withdrawn at this stage with liberty as aforesaid.
