Mr. Vikas Singh, Advocate for the respondent. PANKAJ JAIN, J. (ORAL) Counsel for the petitioner very fairly submits that in view of stand taken by the respondent in their written statement as detailed out in Para 3 of the preliminary objections to the following effect :- "3.

That it is further relevant to mention here that the petitioner had retired from service on 31.5.2009 and as admitted by him in his representation, Annexure P-5, a show cause notice dated 4.5.2009 was issued to him so far as item at Sr.no.4 is concerned. Thus, the show cause notice was issued while the petitioner was in service. Therefore, at the time of retirement, the said matter was still pending. The bar of 4 years therefore does not come into play. It is further relevant to mention here that the sum of Rs.10827/- mentioned in the order dated 26.11.2009 was ordered to be released on 25.7.2014. Similarly, so far as the amount mentioned at Sr. No.2 & 3 are concerned, only a sum of Rs.6436.96 has been retained and the remaining amount of Rs.54,500/- has been ordered to be released ot the petitioner vide order dated 9.5.2015."
