Civil Writ Petition No.17823 of 2016.

Date of Decision: August 31, 2016 Rajinder Singh and others ......Petitioners versus Union of India and others .....Respondents CORAM: HON'BLE MR.JUSTICE SURYA KANT.

HON'BLE MR.JUSTICE SUDIP AHLUWALIA.

*** Present: Mr.S.S.Rangi, Advocate, for the petitioners. -.-

1. Whether Reporters of Local papers may be allowed to see the judgment?

2. To be referred to the Reporters or not?

3. Whether the judgment should be reported in the Digest? --- Surya Kant, J . (Oral) The petitioners claim themselves to be owners of the land described in the head-note of the writ petition, on the basis of a declaratory decree dated 02.11.1993 passed by Civil Court, Ludhiana in Civil Suit No.220 dated 30.05.1987. Before such declaration, the land was requisitioned under the Requisitioning and Acquisition of Immovable Property Act, 1952. The Award was passed in the year 1994 obviously in the name of original owners. The petitioners claimed to have been running from pillar to post for payment of compensation but nothing has happened so far. A legal notice is said to have been served on 31.07.2008 followed by some representations and reminders.

On a query, the petitioners are unable to inform whether or not the original owners received the compensation? Mohinder Kumar Kamboj 2016.09.16 11:32 I attest to the accuracy and integrity of this document Chandigarh

CWP No.17823 of 2016 [2] The writ petition is filed with vague and evasive averments. We thus dispose of it without expressing any views on the merits of the petitioners' claim, with a direction to respondent Nos.3 & 4 to ascertain the correct fact and dispose of the claim by way of a reasoned order within a period of four months from the date of receiving a certified copy of this order. In case the petitioners' claim is rejected, we make it clear that they may, if so advised, file civil suit as the controversy involves disputed question of facts.

Ordered accordingly.
