IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No. 18819 of 2015 Date of decision: 08.09.2015 Sarita Jain College of Education ....Petitioner(s)

Versus

State of Haryana and others

...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. Rahul Sharma-I, Advocate, for the petitioner.

G.S.SANDHAWALIA, J. (Oral) Counsel contends that the petitioner was declared a Jain Minority Institution on 07.10.2013 (Annexure P-1) by respondent no. 2. Thereafter, it was granted recognition for running the course of Diploma and Elementary Education with intake of 50 students on 03.03.2015 (Annexure P-2) by the NCTE. It accordingly thereafter applied for permission to admit students to respondent no. 2 on 12.05.2015 (Annexure P-3) and for grant of recognition to respondent no. 3 on 14.05.2015 (Annexure P-4). The request of the petitioner was forwarded by respondent no. 3 to respondent no. 2 on 21.05.2015 but no action has been taken till now.

Counsel submits that he would be satisfied if a direction is issued to respondent no. 2 to take action on the applications of the petitioner for the affiliation and for permission to admit. Accordingly, keeping in view the limited relief sought and without commenting on the merits of the case, this Court does not feel necessary to call upon the respondents to file reply. Accordingly, this writ petition is disposed of with a direction to respondent no. 2 to decide the above issues within a period of 10 days from from the date of receipt of certified copy of the order. Needless to say that in case the relief is to be denied, the order should contain reasons. 08.09.2015 (G.S. SANDHAWALIA) shivani JUDGE SHIVANI GUPTA 2015.09.09 15:17 I attest to the accuracy and integrity of this document Chandigarh
