IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No.1259 of 2018 Date of Decision : 22.01.2018 Parampreet Singh Randhawa ....Petitioner

Versus

State of Punjab and others ....Respondents CORAM : HON'BLE MR.JUSTICE MAHESH GROVER HON'BLE MR.JUSTICE RAJBIR SEHRAWAT Present: Mr.C.M.Munjal, Advocate for the petitioner.

MAHESH GROVER, J. (Oral) The lease agreement has not been registered as the petitioner failed to meet the requisite of depositing 4% of the lease money by way of stamp duty. Mr. Munjal contends that this demand itself is under challenge in numerous petitions and therefore, any subsequent action by the official respondents to cancel the lease would be highly prejudicial to his cause, particularly when he is ready to deposit 50% of the amount by way of stamp duty. We find that the petitioner has not impugned Annexure P-9 where the original demand was raised.

Confronted with this situation, learned counsel for the petitioner prays for permission to withdraw the instant petition with liberty to file a fresh one instead of amending the present one. Permitted to do so. Dismissed as withdrawn with the liberty aforesaid granted. (MAHESH GROVER) JUDGE 22.01.2018 (RAJBIR SEHRAWAT) dss JUDGE Whether speaking/reasoned Yes/No Whether reportable Yes/No
