Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.162 dated 22.07.2017 under Sections 419, 420, 465, 467, 468, 471 and 120-B IPC, registered at Police Station City Faridkot.
Notice of motion was issued. Learned State counsel appeared and contested the petition.
I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. The FIR in the present case is of 22.07.2017. Learned State counsel contended that the petitioner is avoiding his arrest for the last two years and PO proceedings are going on, as instructed by ASI Sukhdev VINEET GULATI 2019.07.26 12:15 I attest to the accuracy and authenticity of this document Chandigarh
CRM No.M-29562 of 2019 -2Singh. As per prosecution version, agreement to sell has been forged by gang of land grabbers and present petitioner is witness to the agreement to sell. As the petitioner is witness and he wrongly identified other person, therefore, he is one of the main accused.
Keeping in view the above facts and circumstances of the present case, I find that petitioner is required for custodial interrogation and no ground is made out to grant benefit of anticipatory bail to him. Therefore, finding no merit in the present petition, the same is dismissed.
